There is important legislation that needs to be adhered to when you decide to put your rented property on the market. 

 

A Form 10 has to be issued by your selling agent to your tenant advising them that the property is going to be listed for sale. 

 

Your tenants in discussion with the agent can advise whether they are happy to have a For Sale board erected on the property, agree to open homes and whether they consent to having internal photos taken for the purpose of marketing. 

 

The selling agent requires an entry notice when conducting viewings and these appointment are usually conducted as to not disrupt the quiet enjoyment of a tenancy.

 

So you can see it is very important that your selling agent and property manager are able to maintain a cohesive relationship with your tenant to negotiate a successful outcome for all parties.

 

Tenancies are protected so any sale concluded will be made subject to the tenant’s existing lease.
